These Terms of Use (“Terms”) govern your access to and use of BadmintonLive, accessible at badmintonlive.net (the “Platform”), operated by SMV Badminton Live (“we”, “us”, or “our”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not use the Platform.

Please read these Terms carefully before using the Platform. These Terms constitute a legally binding agreement between you and BadmintonLive.

1. Acceptance of Terms

By accessing, browsing, or using the Platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated into these Terms by reference. If you are using the Platform on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting on this page. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. Eligibility

You must be at least 13 years old to use the Platform. If you are under 18, you represent that you have obtained the consent of a parent or legal guardian to use the Platform and that your parent or guardian has read and agrees to these Terms on your behalf.

By creating an account, you represent and warrant that you are at least 13 years of age and that all information you provide is accurate, current, and complete.

3. Account Registration & Security

Certain features of the Platform (such as saving favourite players, participating in live chat, and accessing content beyond the engagement wall) require you to create an account. To create an account, you must provide a valid phone number and verify it through a one-time password (OTP) sent via SMS.

You agree to:

• Provide accurate and truthful information during registration.
• Keep your account credentials secure and not share them with others.
• Notify us immediately if you suspect unauthorised access to your account.
• Not create multiple accounts for the purpose of abusing platform features.
• Not use someone else's phone number to create an account without their permission.

You are solely responsible for all activity that occurs under your account, whether or not you authorised it. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

4. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. Specifically, you agree NOT to:

• Use the Platform for any illegal or unauthorised purpose, or in violation of any applicable local, national, or international law or regulation.
• Attempt to gain unauthorised access to any part of the Platform, other users' accounts, or any systems or networks connected to the Platform.
• Interfere with, disrupt, or place an unreasonable burden on the Platform's infrastructure, servers, or networks.
• Use automated tools, bots, scrapers, crawlers, or any other automated means to access, collect data from, or interact with the Platform without our express written permission.
• Copy, reproduce, distribute, modify, display, perform, or create derivative works from any content on the Platform without our prior written consent.
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Platform.
• Impersonate any person or entity, or falsely represent your identity or affiliation with any person or entity.
• Use the Platform to transmit any viruses, malware, worms, trojan horses, or other malicious code.
• Circumvent, disable, or otherwise interfere with any security features of the Platform, including the engagement wall.
• Resell, redistribute, or commercially exploit any part of the Platform or its content without our prior written consent.
• Use the Platform to harvest or collect phone numbers, email addresses, or other personal information of other users.
• Frame, mirror, or embed the Platform or any portion of it on another website or application without our prior written consent.

5. Live Chat & Community Guidelines

Our live chat feature allows registered users to communicate with other users during live streams. By using the live chat, you agree to the following community guidelines:

We reserve the right to moderate, edit, or remove any chat messages that violate these guidelines at our sole discretion, without notice. Users who repeatedly or severely violate community guidelines may have their chat privileges suspended or their accounts terminated.

We do not pre-screen chat messages and are not responsible for the content posted by users. If you encounter any content that violates these guidelines, please report it to contact@badmintonlive.net.

6. Content & Data Accuracy

All match data, live scores, match odds, world rankings, tournament schedules, and news articles displayed on the Platform are sourced from publicly available information and third-party data providers. While we make reasonable efforts to ensure accuracy and timeliness, we do not guarantee that:

• All information is complete, accurate, or current at all times.
• Live scores reflect the actual score at any given moment (delays may occur).
• Match odds are identical to those offered by any specific betting provider.
• Rankings reflect the most current official BWF standings at all times.
• News articles are free from errors or represent the views of BadmintonLive.
• Tournament schedules will not change without notice from organisers.

You should not rely solely on information from the Platform for any purpose where accuracy is critical, including but not limited to gambling, financial decisions, or professional analysis. Always verify information with official sources where necessary.

All original content, design, graphics, logos, branding, software, code, and user interface elements on the Platform are the property of SMV Badminton Live or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws.

You may NOT without our prior written consent:

• Copy, reproduce, or distribute any content from the Platform.
• Use our trademarks, logos, or branding for any purpose.
• Create derivative works based on the Platform or its content.
• Remove or alter any copyright, trademark, or other proprietary notices.

Third-party content displayed on the Platform — including news articles, player images, tournament logos, and country flags — remains the intellectual property of their respective owners. Such content is used for informational purposes and is attributed to its original source where applicable.

Player names, tournament names, and the BWF logo are trademarks of their respective owners. BadmintonLive is not affiliated with the Badminton World Federation (BWF) or any national badminton association.

9. Live Streaming

Live streams on the Platform are provided by authorised streamers. By watching a live stream, you agree to:

• Not record, capture, download, or redistribute any live stream content.
• Not re-broadcast or re-stream any content from the Platform to any other platform or service.
• Not circumvent any access controls or restrictions on stream content.

We do not guarantee the availability, quality, or continuity of any live stream. Streams may be interrupted, delayed, or unavailable due to technical issues, network conditions, or other factors beyond our control. We are not liable for any interruption or unavailability of streams.

10. Engagement Wall & Free Access

BadmintonLive is free to use. However, after a period of continuous usage in a single session, you may be prompted to create a free account to continue using the Platform (the “engagement wall”). This is a standard practice used to build our community and ensure a quality experience for all users.

Account creation is free and requires only a phone number for OTP verification. We will never charge you for using the Platform. Attempting to bypass or circumvent the engagement wall is a violation of these Terms.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BADMINTONLIVE AND ITS OWNERS, OPERATORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses.
• Any damages arising from your use of or inability to use the Platform, including interruptions, errors, delays, or security breaches.
• Any damages resulting from any content, data, or information obtained from or through the Platform, including inaccurate scores, odds, rankings, or news.
• Any damages resulting from unauthorised access to or alteration of your data or transmissions.
• Any damages resulting from statements or conduct of any third party on the Platform, including in live chat.
• Any losses or damages arising from gambling or betting decisions made based on information displayed on the Platform.

The Platform is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify, defend, and hold harmless BadmintonLive and its owners, operators, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of or access to the Platform.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Your violation of any third-party rights, including intellectual property rights.
• Any content you post or submit to the Platform, including chat messages.

13. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to:

• Violation of these Terms or community guidelines.
• Abusive, harmful, or fraudulent behaviour.
• Requests from law enforcement or government agencies.
• Discontinuation or material modification of the Platform.
• Extended periods of inactivity.
• Technical or security issues.

Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Malaysia.

15. Severability

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BadmintonLive regarding your use of the Platform and supersede all prior agreements, understandings, and communications, whether written or oral.

17. Waiver

The failure of BadmintonLive to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorised representative of BadmintonLive.
